Propofol and Lethal Injection
Dear Health Care Professional,
Earlier today, Missouri Governor Jay Nixon announced his state would not use Propofol in scheduled executions. Fresenius Kabi applauds his decision and we hope other states take his lead. As a result, we are lifting the temporary allocation on Diprivan® (propofol), and we encourage customers to continue normal purchasing patterns.
Fresenius Kabi takes no position on capital punishment, but we object to the use of Propofol in lethal injection. Such use is contrary to the FDA-approved indications for Propofol and would lead the European Union (EU), where about 90 percent of the drug is manufactured, to impose severe restrictions on its export to the United States.
To help mitigate any future potential export sanctions, we have been ramping up production. In the United States, we will continue with the specific distribution controls we put in place more than a year ago to help assure access to Propofol for therapeutic use and to prevent its sale to correctional facilities.
